These terms are the agreement between you and Thynkr Systems Ltd when you use NearPulse. We've kept them short and in plain English. By installing, opening or otherwise using NearPulse, you accept them.
1. About NearPulse
NearPulse is a location-aware briefing and safety app that surfaces information such as weather, fuel prices, transport status, road closures, grocery prices, NHS availability and local alerts. NearPulse is a trading name of Thynkr Systems Ltd, a company registered in England & Wales (Company No. 15306717), with its registered office at Office 1, 1st Floor, 73 Station Passage, London E18 1JL, United Kingdom.
In these terms, "NearPulse", "we", "us" and "our" mean Thynkr Systems Ltd. "You" means the person using the app or website.
2. Eligibility & accounts
You must be at least 13 years old to use NearPulse, and at least 16 to create an account. If you're under 18, you confirm you have a parent or guardian's permission.
You don't need an account for most of the app. If you do register, you agree to:
Provide accurate information and keep it up to date.
Keep your login credentials confidential. You are responsible for activity on your account.
Tell us promptly at [email protected] if you suspect unauthorised access.
3. Your licence to use the app
Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use NearPulse on devices you own or control, for your own non-commercial use.
This licence doesn't give you rights to copy, modify, translate, reverse-engineer, decompile or create derivative works, except where applicable law says we can't stop you.
4. Acceptable use
You agree not to:
Break the law or anyone else's rights while using NearPulse.
Scrape, reverse-engineer or bulk-extract the data we surface.
Interfere with the service, our infrastructure, or other users (including denial-of-service, credential stuffing, spam, etc.).
Upload, submit or transmit content that is unlawful, defamatory, harassing, hateful, obscene, or that violates someone's privacy or intellectual property.
Use NearPulse to harm, stalk or surveil another person.
Attempt to access accounts, data or systems you are not authorised to access.
Resell, sub-licence or commercially exploit the app without our written permission.
We reserve the right to remove content and suspend accounts that break these rules.
5. Content & briefings
NearPulse aggregates and presents information from public feeds, third-party providers and community contributions. We try to keep it accurate and timely, but:
Briefings are informational, not authoritative. Fuel prices, grocery prices, transport times, opening hours and road closures can change minute-by-minute. Always verify with the relevant operator (retailer, transport authority, NHS, etc.) before making time-critical or safety-critical decisions.
We do not guarantee that any price, time, status or event shown in the app is current, complete or accurate. You rely on NearPulse information at your own discretion.
6. Emergency & SOS features
NearPulse is not an emergency service. In a life-threatening emergency always call 999 (UK), 112 (EU), 911 (US/Canada) or your local equivalent first.
The SOS feature is designed to help you share your location with a chosen emergency contact and to surface local emergency numbers quickly. It depends on your device's GPS, mobile signal, battery, operating-system permissions and the availability of carrier SMS/voice networks — none of which we control.
We do not guarantee that an SOS message will be delivered, received, read or acted upon. You accept that the SOS feature is an aid, not a replacement for the emergency services.
7. Third-party data & links
NearPulse integrates data from a range of sources, which may include (without limitation) UK government open data, fuel price feeds, transport operator APIs, weather providers, news publishers and community submissions. Those sources have their own terms and may change, pause or withdraw their data at any time.
Any external links (e.g. to an operator's website, an NHS page, a news article) are provided for convenience. We are not responsible for the content, policies or practices of third-party sites and services.
8. Intellectual property
NearPulse, the NearPulse name and logo, the app, website, software, design and original content are owned by Thynkr Systems Ltd (or our licensors) and are protected by copyright, trademark and other laws. All rights not expressly granted to you are reserved.
Your content
If you submit reports, ratings, comments or other content through NearPulse (for example community-submitted road or outage reports), you keep ownership of it. You grant us a worldwide, royalty-free, sub-licensable licence to host, store, reproduce, adapt and display that content for the purpose of operating and improving NearPulse.
You warrant that anything you submit is yours to submit, accurate to the best of your knowledge, and doesn't infringe anyone's rights.
9. Fees & subscriptions
The core NearPulse app is currently free to use. We may introduce optional paid features or subscription tiers in the future. If we do, pricing, billing cycle and cancellation terms will be disclosed clearly at the point of purchase, and your purchase will be subject to the terms of the relevant app store (Apple App Store or Google Play).
Where applicable, statutory consumer cancellation rights under UK law will apply.
10. Availability & changes
We do our best to keep NearPulse available 24/7, but we don't promise uninterrupted service. Scheduled maintenance, unexpected outages, network issues, app-store policies and third-party data changes can all affect availability.
We may add, modify or remove features, change how the app looks, or retire parts of the service. If a change materially reduces functionality you rely on, we'll try to give you reasonable notice.
11. Suspension & termination
You can stop using NearPulse at any time by uninstalling the app and (if you have one) requesting account deletion via [email protected].
We may suspend or terminate your access, with or without notice, if:
You breach these terms or the Acceptable Use rules.
We're required to by law, court order or regulator.
Continuing to serve you would create a security, legal or safety risk.
We retire the service (we'll give reasonable notice where practicable).
Clauses that by their nature should survive termination (IP, liability, indemnity, governing law) will continue to apply.
12. Warranty disclaimer
NearPulse is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties — including merchantability, fitness for a particular purpose, accuracy, reliability and non-infringement.
We don't warrant that the app will be error-free, uninterrupted, secure against all threats, or that data displayed will be accurate or current.
13. Limitation of liability
Nothing in these terms limits or excludes our liability for:
Death or personal injury caused by our negligence.
Fraud or fraudulent misrepresentation.
Any other liability that cannot lawfully be limited or excluded under English law, including your statutory rights as a consumer.
Subject to the above, to the maximum extent permitted by law:
We will not be liable for any indirect, incidental, consequential, special or punitive damages — including loss of profits, revenue, data, goodwill or opportunity — arising from or related to your use of NearPulse.
Our total aggregate liability for all claims arising from or related to the service in any 12-month period will not exceed £100, or the fees you actually paid us for the service in that period, whichever is greater.
You accept that NearPulse is an informational and safety-assistance app and that decisions you make (travel, purchase, routing, emergency action, etc.) remain your responsibility.
14. Indemnity
You agree to indemnify and hold harmless Thynkr Systems Ltd, its directors, employees, agents and licensors from and against any third-party claims, losses, damages, liabilities and reasonable legal costs arising out of:
Your breach of these terms.
Your misuse of the app or service.
Content you submit to NearPulse.
Your violation of any law or of any third-party right.
15. Governing law & disputes
These terms and any dispute or claim arising out of them are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction, except that if you are a consumer resident in another part of the UK, you may also bring proceedings in the courts of your home jurisdiction.
If any part of these terms is found to be unenforceable, the rest will remain in full force.
16. Changes to these terms
We may update these terms from time to time. If the change is material, we'll notify you in-app, by email, or via a notice on this page at least 14 days before it takes effect. Continuing to use NearPulse after the effective date means you accept the updated terms. If you don't agree, stop using the service and (if you have one) close your account.
