1. About NearPulse

NearPulse ("the App", "the Service") is a hyperlocal AI briefing application developed and operated by Thynkr Systems Ltd (Company No. 15306717), registered in England and Wales, with its registered office at Office 1, 1st Floor, 73 Station Passage, London E18 1JL ("we", "us", "our").

NearPulse provides personalised local information including weather, transport updates, fuel prices, grocery prices, bin collection reminders, road closures, NHS wait times, local news, events and an SOS emergency feature.

2. Acceptance of Terms

By downloading, installing or using NearPulse, you confirm that:

• You are at least 13 years of age
• You have read and agree to these Terms of Service
• You have read and agree to our Privacy Policy
• You have the legal capacity to enter into a binding agreement

If you do not agree to these terms, please do not use NearPulse.

3. Account Registration

To use NearPulse you must create an account. You agree to:

• Provide accurate and truthful information during registration
• Keep your login credentials secure and confidential
• Notify us immediately if you suspect unauthorised access to your account
• Be responsible for all activity that occurs under your account
• Not create accounts for others without their consent
• Not use another person's account without permission

We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription Plans & Payments

Free Plan

NearPulse offers a free plan with core features available at no charge. The free plan is subject to usage limits as described in the app.

Pro Subscription

• Pro Monthly: £2.99 per month
• Pro Annual: £19.99 per year (saving approximately 44% vs monthly)

Billing

• Subscriptions are billed through Apple App Store or Google Play Store
• Payment is charged to your App Store or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Prices are displayed in GBP and may vary by country based on App Store pricing

Cancellation & Refunds

• You may cancel your subscription at any time through your App Store or Google Play account settings
• Cancellation takes effect at the end of the current billing period — you retain access until then
• Refunds are handled in accordance with Apple App Store and Google Play Store refund policies
• We do not offer refunds directly — please contact Apple or Google for refund requests

5. Acceptable Use

You agree to use NearPulse only for lawful purposes. You must not:

• Use the app for any illegal or fraudulent purpose
• Attempt to reverse engineer, decompile or hack the app
• Use automated tools to scrape or extract data from the app
• Attempt to gain unauthorised access to our systems
• Abuse the SOS feature — false SOS activations waste emergency resources
• Impersonate any person or organisation
• Submit false or misleading information
• Violate any applicable local, national or international laws

6. SOS Emergency Feature

Regarding the SOS feature:

• The SOS feature sends your GPS location to your nominated emergency contact via SMS
• Delivery of SMS messages depends on Twilio's service and your contact's mobile network — we cannot guarantee delivery
• You are responsible for ensuring your emergency contact details are correct and up to date
• We are not liable for any harm, injury or loss arising from reliance on the SOS feature
• Deliberately misusing the SOS feature may result in account suspension
• NearPulse does not contact emergency services on your behalf

7. Information Accuracy

NearPulse aggregates data from multiple third-party sources including government APIs, transport providers, retailers and news services. While we strive for accuracy:

• We cannot guarantee that all information is accurate, complete or up to date at all times
• Fuel prices, transport status and wait times may not reflect real-time conditions
• Bin collection dates are sourced from council APIs and may not reflect last-minute changes
• NHS wait times are estimates and may change rapidly
• Always verify critical information from official sources before making decisions

NearPulse information should be used as a guide only — not as the sole basis for important decisions.

8. Intellectual Property

All content, design, code, branding and intellectual property within NearPulse — including the Lana AI brand — is owned by Thynkr Systems Ltd or its licensors. You may not:

• Copy, reproduce or distribute any part of NearPulse without written permission
• Use our trademarks, logos or branding without permission
• Create derivative works based on NearPulse

Your personal data and content you provide remains yours. You grant us a limited licence to process it for the purpose of providing the service.

9. Third-Party Services

NearPulse integrates with third-party services to deliver functionality. We are not responsible for the availability, accuracy or conduct of these third-party services. Your use of third-party services through NearPulse is subject to their own terms and privacy policies.

10. Disclaimers & Limitation of Liability

NearPulse is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law:

• We do not warrant that the app will be uninterrupted, error-free or secure
• We are not liable for any indirect, incidental or consequential damages arising from your use of the app
• Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss arising from reliance on inaccurate third-party data
• Nothing in these terms limits our liability for death, personal injury or fraud

Your statutory rights as a consumer under UK law are not affected by these terms.

11. Service Availability

We aim to provide a reliable service but cannot guarantee 100% uptime. We may:

• Suspend the service temporarily for maintenance with or without notice
• Modify, add or remove features at any time
• Discontinue the service with reasonable notice to users

In the event of discontinuation of a paid subscription, we will provide a pro-rata refund for any unused period.

12. Account Termination

You may delete your account at any time through the Settings section of the app. We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behaviour
• Misuse the SOS feature
• Provide false registration information

Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under the consumer protection laws of your country of residence.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of NearPulse after changes take effect constitutes acceptance of the updated terms.
